DOCK RULES AND REGULATIONS

The following terms apply: Boat Dockage Agreement (License), the Licensor: St. Petersburg Yacht Club (SPYC or Club), the Licensee: Boat Owner (Boat Owner).

SECTION I – GENERAL

1. The following RULES AND REGULATION are established by the St. Petersburg Yacht Club and shall be strictly observed and complied with by all Boat Owners of vessels at the St. Petersburg Yacht Club Docks and Marina.
2. Good order and proper decorum must be observed at all times. The use of the SPYC docks is at the Boat Owner’s risk. The SPYC Board of Directors, Flag Officers, Port Committee, Management and employees are not responsible and shall be held harmless for any damage or loss including loss of life while approaching, using or leaving the SPYC docks.
3. There is no implied strength to the pilings or docks, and no safety or guarantee from damage from the docks, other vessels on or near the docks, wiring or free electrical current in or around the docks, or from acts of nature.
4. Dock carts are available and MUST be returned to the dock house after use. Dock carts may be taken to the curb for loading and unloading, but are not to leave SPYC property.

5. Motorized vehicles must be walked from the vessel to the Dock entrance gate. They may not be stored on the docks. Vehicles for disabled persons are exempt.
6. No garbage, trash, paint, untreated sewage, oil or oily bilge water shall be left on the docks, in dock boxes or thrown overboard.

7. Charcoal burners, gas torches, burning or welding equipment, or any open flame producing equipment is prohibited, except within an enclosed vessel for cooking purposes and at the Boat Owners risk .

8. Domestic pets are permitted, provided they are kept leashed when not confined aboard, do not disturb other Boat Owners or their guests, and do not otherwise create a nuisance. Pets must be walked outside the Marina.

9. Please pick up after pets and dispose of all feces in appropriate plastic containers and place in curbside dumpster.

10. Laundry of any type, or any item of personal property of an unsightly nature, shall not be hung-out or spread-out to dry or air in public view on any vessel or dock.
11. "For Sale" signs are not permitted on any vessel at the docks.

12. No advertising or soliciting will be permitted at the SPYC Marina without written permission from the Port Committee.
13. No fishing or fish cleaning is permitted on the docks or from any vessel tied to the docks at any time. Feeding of gulls, fish, and other wildlife from the docks is prohibited.

14. Swimming and diving for recreation or pleasure in Marina water is prohibited.

15. There shall be no disorderly conduct by a Boat Owner, their crew or guests that might injure a person, cause damage to property, disrupt the order of the Marina facility, or otherwise interfere with the quiet enjoyment of other Boat Owners.

16. Boat Owners shall use discretion in the use of TV sets, musical instruments, loud hailers, radios, and any other sound equipment so as not to create a nuisance or to disturb the quiet enjoyment of other Boat Owners at the Marina. Rigging shall be secured in such a manner as to prevent noise.

17. For security and safety reasons, the use of, or access to the Marina and docks is restricted to Boat Owners, their crew and guests.

18. An Ice Machine is located by the Dockmasters office. The fee is posted on the machine and is on the honor system.

19. A coin operated washer and dryer are available in the restroom area. Any problems with its use should be reported to the Dockmaster.

20. Showers and heads are located by the Dockmasters office. Please clean up after you are through using them.

21. Parking is available for SPYC members in the Club garage. Cars left overnight are subject to a minimal charge. After hours and holidays the Club garage is locked. Parking may not be available during certain Club events.

22. Temporary parking is available curbside in front of the Main Gate. Please be considerate of others, as there are only 3 spaces total for the north and south sections and they are for 30 Minute Parking ONLY.

23. Specific variances to the SPYC Dock Rules and Regulations may be granted by the Port Committee in cases where the intent of the rule is met but not the specific requirement or where the basis for the variance is deemed sufficient in the discretion of the Port Committee.

24. Suggestions, comments or complaints are encouraged. They should be written and submitted to the Port Captain in care of the Dockmaster or e mailed to: portcaptain@spyc.org.

SECTION II – SLIP ASSIGNMENTS & TRANSFERS
1. Boat Dockage Agreements are a privilege. SPYC is under no obligation to renew a yearly Agreement and may revoke an Agreement without refund. Revocation of an Agreement and removal of a Boat Owner and the vessel from the Docks may be the result of disruptive or unsafe behavior, potential damage to Club property or the property of others, or any other indication considered adequate by the Port Committee. The Port Committee with Board of Directors approval or the Board of Directors may recommend a License be revoked and the vessel removed within 30 days from notice.

2. Dockage, anchorage or mooring assignments will be made by the Port Committee. No changes in assignment will be made without the Port Committee’s prior approval, and only after a new Agreement is executed by the Boat Owner and the Club.
3. Slips are licensed on a yearly basis, payable in advance, with no sublease privileges. Dock charges are subject to change. Agreements are only to members of SPYC.
4. Assignment to a slip is at the discretion of the Port Committee. A wait list will be maintained by the Dockmaster.
5. The Port Committee will select vessels for slip assignment based on the following criteria:
• Length of time on the waiting list
• Size of slip available
• Balance of sail and power yachts (60% sail, 40% power)
• Active boat owner
• Participation in club activities and club usage
6. Boat Owner’s vessel must be berthed in assigned slip while in home waters that comprise the specified counties of a Resident Member as described in the SPYC By-Laws.
7. Renewal Agreements must be signed prior to October 1st of each year. However, the Club is not obligated to renew an annual Agreement with a Boat Owner.

8. A requirement of the Agreement is for the Boat Owner to keep insurance and registration / documentation current and provide proof thereof at the time of the license execution and renewals. Failure to provide this information is cause for termination of license.
9. A non-renewal notice will be mailed thirty (30) days in advance for removal of the vessel.
10. It shall be the responsibility of the Boat Owner to keep their vessel in such condition that they do not become unsightly, dilapidated, or reflect unfavorably on the appearance standards of the SPYC Marina facilities.
11. It is the policy of the Club that docks shall be occupied by vessels that are actively used and maintained by the Boat Owner. To comply with this policy the vessel must vacate the SPYC Marina and St. Petersburg City boat basin at least once each calendar quarter. It is the Boat Owner’s responsibility to notify the Dockmaster when compliance takes place.

12. Slips shall not be occupied by vessels, which in the opinion of the Port Committee, appear to indicate inactivity for any one or more, of the following reasons:
• lack of proper maintenance
• vessel not seaworthy
• vessel not visited or used regularly

13. The Port Committee will notify Boat Owner in writing that they are not in compliance with the Rules and Regulations and will have 30 days to comply. Failure to comply will subject Boat Owner to termination of Agreement.
14. Eligible vessels must be registered to Club member, spouse or a legal entity which is owned and controlled by the Club member.
15. Vessels must be a minimum of 23’ LOA to a maximum of 70’ LOA. LOA includes all bow and stern appendages. LOA can be measured at the fuel dock.
16. No Boat Owner may be assigned more than one slip.
17. When a registered vessel is sold, the Boat Owner must inform the Dockmaster in writing within ten (10) days of the date of sale and indicate his intention to replace said vessel. If the Boat Owner does not intend to replace the sold vessel, the slip will be reassigned immediately. Otherwise, the slip will be held for ninety (90) days pending the purchase of a new vessel, unless there are extenuating circumstances, which must be approved by the Port Committee.

18. In order to accommodate the greatest number of vessels possible, SPYC reserves the right to change slip assignments.

19. A Boat Owner may request a slip reassignment by submitting a written request to the Port Committee, stating reason the change is desired. Slip reassignment is at the discretion of the Port Committee and may not be assumed by the Boat Owner.

20. Slips must be vacated at times as may be ordered by the Board of Directors.
21. The Dockmaster may assign slips to other vessels in the absence of the registered vessel. It is the responsibility of the Boat Owner to communicate with the Dockmaster when the vessel will be leaving and returning from the assigned slip.
22. The Dockmaster may place transient vessels in locations that block some slips. Only the Dockmaster or the owner of the transient vessel may authorize the movement of the vessel so the blocked vessel may leave or return. The registered vessel may tie up in another available slip until her slip becomes unblocked or vacated.
23. Dock charges are subject to change. Current charges may be obtained from the Dockmaster. Dock charges are subject to applicable taxes.

24. Any installation of items desired by the Boat Owner at his slip or in the Marina must be approved by the Port Committee. Installation must be done by Club maintenance department at Boat Owners expense.

25. Upon termination of slip license, those items installed by Boat Owner become property of the Club. If the Club wants the items removed, it will be at the Boat Owner’s expense and charged to their account.

26. No addition, alteration, or modification shall be made to the electrical or water supply or any other utility service without written permission from the Port Committee.

27. The Boat Owner hereby understands and agrees that the SPYC may cancel and shutoff water and electric utility services, or otherwise discontinue the provision of said services for any reason whatsoever, including if the Boat Owner is delinquent in his payments due to the SPYC or is otherwise in default under any provision of the Agreement.

28. It is the present policy that only Resident SPYC Boat Owners are eligible for Dockage Agreements and slip assignment.

29. The SPYC Dock Policy prohibits live-a-boards. If a Boat Owner has a question as to their liveaboard status, they should check with the Port Committee.

SECTION III – SAFETY
1. The fuel dock is for service only. No tie-up is permitted except in case of emergency for quick discharge or boarding as directed by the Dockmaster.

2. Refueling is only permitted at the fuel dock. Fuel shall be stored in approved containers. There shall be no storage of any flammable substances on or near the docks or in dock boxes.
3. Only the Dockmaster is authorized to DISPENSE fuel and oil. The Dockmaster will not REFUEL a vessel. The SPYC is not responsible for any damage to a vessel while fueling and does not guarantee the quality of the fuel.

4. No refuse, solid or liquid, shall be discharged overboard. All garbage and trash shall be placed in receptacles provided. No effluent from toilets or heads, nor oil from bilges, shall be discharged overboard. Only Coast Guard approved sanitation devices will be acceptable
5. Hazardous waste materials must be disposed of properly and not placed in trash containers.
6. Open flames are not allowed on boats or docks.
7. Vessels must be positioned in the slip so as to prevent any bow or stern appendages from extending over the dock
8. In an emergency or safety situation the Dockmaster has the authority to have a vessel removed from the SPYC Docks or take other measures as deemed necessary at the Boat Owners expense.
9. If it is necessary for a vessel docked at the SPYC Marina to be moved for whatever reason and the Boat Owner is not available to move the vessel in a timely manor, the Dockmaster will arrange to have the vessel moved by a licensed Captain at the Boat Owners expense.

10. All Boat Owner’s must maintain their vessels in a state of constant readiness for movement in case of emergencies. Boat Owner’s of vessels whose propulsion machinery is inoperative for a period in excess of twenty-four (24) hours must notify the Dockmaster immediately and inform him of the action being taken to place the vessel’s machinery in operation as soon as possible. The Dockmaster may temporarily reassign or relocate these vessels. An exception will be made for sailing vessels under 30’ LOA without auxiliary power. This MUST be noted on the Boat Owner’s application.

11. All vessels must have adequate, permanently installed, electrical or mechanical bilge pumps in constant state of readiness. Switches should be labeled and installed in readily discernible locations.
12. During hurricane season (June 1st through November 30th) extra safety measures (double line, heavier/larger diameter lines, etc.) are mandatory and are the responsibility of the Boat Owner.
13. In the event of a mandatory evacuation notice the Dockmaster will be evacuating the docks once the facility has been secured. Fuel pumps will be shut off and locked; electricity shut off and miscellaneous club equipment secured.

14. The Dockmaster will attempt to contact the Boat Owner if his lines are inadequate or need replacement to protect our property or the property of others. New lines may be added and billed to the Boat Owner’s account. The lack of notification or replacement of lines by the Dockmaster does not release the Boat Owner from his responsibility to maintain his vessel and lines for the conditions that exist.

SECTION IV – MAINTENANCE OF DOCKS AND VESSELS

1. It is the responsibility of Boat Owner to keep the dock areas adjacent to their vessels in an orderly, clean, and safe condition. Docks will be kept clear of all gear, including dinghies and bicycles.

2. Dock boxes, are permitted, and must conform to the SPYC standard as to construction, materials, color and installation. These specifications are available from the Dockmaster.

3. Dock boxes are to be emptied and left unlocked upon issuance of hurricane watch by the National Hurricane Center, or upon termination of the Dockage License Agreement.

4. Bicycles are to be kept in the bicycle racks located at the Dock office.

5. Major repairs, outfitting or refitting of vessels at SPYC Marina facilities is prohibited. Minor repairs, mechanical adjustments, electrical work, and touch up painting is permitted only for vessels regularly docked at the Marina facility.

6. The Dockmaster must be consulted prior to commencing any work. No work may be undertaken which may result in damage, scarring, or staining the surface of the piers, docks, boxes, other vessels or which may otherwise obstruct the flow or passage of normal pedestrian traffic on the docks.

7. Before commencing any work, outside contractors must sign in at the Dockmasters office. They must provide the Club with copies of their liability insurance.
8. During weekdays, with permission of the Dockmaster, Boat Owner may use the dock "T" end for work on their vessel. No such usage shall be permitted on weekends.
9. Management and the Dockmaster have the authority to stop any activity immediately if they feel it may be harmful to our property or the property of others.
10. A work barge may be available for your use at your own risk, but must be reserved from the Dockmaster and returned to the Dockmaster on a daily basis.


The Club reserves the right to modify, rescind and amend the Rules and Regulations, Policies and Procedures and Dockage License as the Club deems necessary, desirable or appropriate. These Rules and Regulations were approved by the Board of Directors on January 24, 2007_




I ACKNOWLEDGE THAT I HAVE READ AND UNDERSTAND THE FOREGOING SPYC RULES AND REGULATIONS AND AGREE TO COMPLY WITH THESE RULES AND REGULATIONS AND ANY AND ALL REVISIONS AS A CONDITION TO USING THE SPYC MARINA FACILITIES. IT IS FURTHER UNDERSTOOD THAT IF I OR MY AGENTS ARE NOT IN COMPLIANCE WITH THE FOREGOING RULES AND REGULATIONS MY DOCKAGE LICENSE IS SUBJECT TO TERMINATION WITH 30 DAYS NOTICE.
